1. Agreement to Terms
By accessing the Beyond the Diamond Performance website, booking a session, or participating in any program offered by Beyond the Diamond Performance ("BTD," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. These Terms and Conditions apply to all visitors, clients, parents, guardians, and athletes who interact with BTD in any capacity.
2. Services
Beyond the Diamond Performance provides baseball and softball training services including but not limited to hitting instruction, fielding instruction, and strength and conditioning programming. Services are delivered in person at our Manassas, Virginia facility. BTD reserves the right to modify, suspend, or discontinue any program or service at any time without prior notice.
3. Booking and Scheduling
All sessions are booked through TheFuturesApp. By booking a session, you confirm that you have read and agree to both these Terms and Conditions and any applicable policies set forth by TheFuturesApp. Session times are subject to availability. BTD does not guarantee the availability of any specific time slot or trainer. Bookings are confirmed only upon receipt of full payment through TheFuturesApp. A confirmation will be sent to the email address provided at the time of booking.
4. Cancellation and Rescheduling Policy
Cancellations and rescheduling requests must be submitted through TheFuturesApp in advance of the scheduled session. Please review the cancellation policy presented during the booking process for specific notice requirements and any applicable fees. BTD reserves the right to cancel or reschedule sessions due to trainer unavailability, facility issues, inclement weather, or other circumstances beyond our control. In the event BTD cancels a session, clients will be offered a rescheduled session or a credit toward a future booking. No-shows without prior notice may forfeit the session fee at BTD's discretion.
5. Payment
All payments are processed through TheFuturesApp. BTD does not store or process credit card information directly. By completing a booking, you authorize payment in the amount displayed at checkout. All fees are listed in U.S. dollars. Prices are subject to change without notice. Changes to pricing will not affect sessions that have already been confirmed and paid. Refunds, if applicable, are handled in accordance with the cancellation policy and are processed through TheFuturesApp.
6. Assumption of Risk and Waiver
Participation in athletic training programs involves inherent physical risks including but not limited to muscle strain, sprains, fractures, and other injuries. By booking a session or allowing a minor to participate, you acknowledge and voluntarily assume all risks associated with athletic training. You agree that Beyond the Diamond Performance, its owners, coaches, trainers, staff, and affiliates are not liable for any injury, illness, loss, or damage arising from participation in BTD programs, whether caused by negligence or otherwise, to the fullest extent permitted by applicable law.
7. Parental and Guardian Consent for Minors
If you are booking a session on behalf of a minor, you represent that you are the parent or legal guardian of that minor and that you have the authority to agree to these Terms and Conditions on their behalf. By completing a booking for a minor, you grant full consent for that minor to participate in BTD training programs and assume all associated risks on their behalf.
8. Code of Conduct
All athletes, parents, and guardians are expected to conduct themselves respectfully at all times while at the BTD facility or participating in any BTD program. BTD reserves the right to refuse service or remove any individual from a session for behavior that is disruptive, disrespectful, or unsafe. Refunds will not be issued for removal due to code of conduct violations.
9. Photography and Media
BTD may photograph or record training sessions for use in marketing, social media, and promotional materials. By participating in a BTD program, you grant BTD permission to use your likeness or your minor child's likeness in such materials without compensation. If you do not wish to be photographed or recorded, please notify BTD in writing prior to your first session. Requests received after participation begins will apply to future sessions only.
10. Intellectual Property
All content on the Beyond the Diamond Performance website, including but not limited to text, graphics, logos, images, and training methodologies, is the property of Beyond the Diamond Performance and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from the BTD website without express written permission from BTD.
11. Website Use
You agree to use the BTD website for lawful purposes only. You may not use the website in any way that could damage, disable, overburden, or impair its functionality, or interfere with any other party's use of the site. BTD is not responsible for the content of any third-party websites linked from our site, including TheFuturesApp. Use of third-party platforms is subject to their own terms of service and privacy policies.
12. Disclaimer of Warranties
The BTD website and all information provided through it are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied. BTD does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Training results vary by individual. BTD makes no guarantee of specific athletic outcomes from participation in any program.
13. Limitation of Liability
To the fullest extent permitted by law, Beyond the Diamond Performance and its owners, coaches, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, even if BTD has been advised of the possibility of such damages. BTD's total liability to you for any claim arising from these Terms shall not exceed the amount paid by you for the specific session or service giving rise to the claim.
14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Prince William County, Virginia.
15. Changes to These Terms
BTD reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the website or BTD services following any changes constitutes your acceptance of the revised Terms.
